OIG Bars Stark-Only Violations From Self-Disclosure Protocol

Providers, including LTACHs and physicians, can no longer resolve potential Stark law-only violations through the HHS Office of Inspector General’s Provider Self-Disclosure Protocol, unless such violations are paired with Federal Anti-Kickback violations, according to the Office of the Inspector General’s recent open letter to providers.  The letter, signed by Inspector General Dan Levinson, also notes that providers will no longer be able to get past the OIG’s front door in this context unless they anticipate a minimum kickback settlement amount of $50,000.  Read More...

Senate Finance Committee Health Reform Option Paper Proposals Would Impact Post-Acute Care Providers

On April 29, 2009 the Senate Finance Committee (“Committee”) released the first of three health reform option papers exploring proposals for reducing costs and improving quality and efficiency in the country’s health care delivery system.  The second option paper addressing potential solutions for reforming health coverage decisions was released on May 14, and the final option paper discussing solutions for financing health care reform is scheduled to be released on May 20.  The policy options contained in the first option paper would shift Medicare payments to post-acute care providers from volume‐based to value‐based purchasing by providing new payment incentives for care that contributes to positive patient outcomes.  The first option paper contains a number of proposals that, if enacted, would significantly affect Medicare payments to long-term acute care hospitals (“LTACH”). California Hospital Files First Lawsuit Challenging a Recovery Audit Contractor Reopening

A California hospital recently challenged the decision of a Medicare recovery audit contractor (RAC), alleging that the RAC unlawfully reopened claims submitted by the hospital. Palomar Medical Center v. Johnson, S.D. Cal., No. 3:09-cv-00605-BEN-NLS (S.D. Cal. complaint filed 3/24/09). The case is the first since the inception of the Medicare RAC program to challenge the ability of RACs to reopen Medicare claims more than one year after payment, and its outcome will significantly affect the ability of hospitals to generally treat Medicare payments as final a year after receipt.
