Why Recessionary Pressures and State Medicaid Cuts Will Create a Challenging Environment for Many LTACHs in 2009

Conventional wisdom holds that hospital profitability follows the income and revenue trends of the communities in which a hospital is located.  If such wisdom holds true, 2009 could be a challenging year for Long Term Acute Care Hospitals (LTACHs) generally, and particularly for those LTACHs that rely heavily on state Medicaid reimbursement.  Read More...

Three of my colleagues recently wrote the below Client Update.  Non-profit LTACHs should closely monitor the ongoing legislative efforts of the Senate Finance Committee and its lead advocate of establishing quantitative charity care and community benefit standards, Senator Charles Grassley.  Non-profit LTACHs should also be congnizant of ongoing state and IRS activities to update financial reporting requirements for not-profit hospitals. The Commonwealth Foundation (Foundation), a private health care foundation supporting independent research on health policy reform, launched a website providing hospital performance data on two dozen measures of recommended care.  The website allows both health care providers and consumers to conduct side-by-side comparisons of over 4,500 hospitals, including many LTACHs, with similar characteristics, such as region, ownership, size, and type.  The website, however, does not allow users to limit their facility-type search to LTACHs. CMS Awards Contracts to Evaluate the Medical Necessity of Patient Admissions to Long Term Acute Care Hospitals

CMS announced on December 19, 2008 that it had awarded two LTACH-related contracts, in accordance with the Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA), to study medical necessity of patient admissions to LTACHs.  The MMSEA, which was signed into law December 29, 2007, made sweeping changes impacting Long Term Acute Care Hospitals (LTACHs). The MMSEA, among other things, provided for a three-year moratorium (with certain exceptions for facilities already under development) on the establishment of new LTACHs, LTACH satellite facilities, and increases in the number of LTACH beds, and also delayed the implementation of certain LTACH payments policies.  The MMSEA also provided for expanded review of Medicare claims data by Fiscal Intermediaries and Medicare Administrative Contractors to ensure that: Read More...

Governor David Paterson released a budget proposal on December 16, 2008 that would significantly reduce New York’s Medicaid spending, while raising more than $1 billion in assessments on hospitals (including LTACHs), other healthcare providers and health insurers.  A Press Release issued by The Healthcare Education Project (a venture between the Greater New York Hospital Association and SEIU Local 1199) estimated potential Medicaid payment cuts of $1.4 billion dollars to hospitals for the 2009-10 fiscal year.  The proposed budget also seeks to raise more than $1 billion in fees, surcharges and assessments on health care providers and insurers, in part, by imposing a a 0.7 percent assessment on hospital inpatient revenues and creating a new $49 million surcharge on procedures performed by physicians in office-based and urgent care settings. Medicare Recovery Audit Contractor (RAC) Update (12/16/08)

One of my colleagues, R. Brent Rawlings, JD, MHA, FACHE, recently wrote the below Client Alert and White Paper discussing the temporarily delayed expansion of the Recovery Audit Contractor (RAC) program.  It is important to note that although RACs may initially focus their audit efforts on Medicare reimbursable services provided by acute care hospitals, LTACH Medicare claims are also subject to review by RACs.
